Safety Aspects
Where appropriate Dukes shall organise the necessary checks and certificates as required. We ensure that these checks are carried out EACH YEAR and ON TIME.
The Furniture and Furnishings (Fire) (Safety) Amendment) Regulations 1993 The above regulations were amended in 1993 and set new levels of fire resistance, for domestic upholstered furniture and furnishings. It is an offence to ‘supply’ in the course of business any furniture that does not comply with the regulations. This includes supplying furniture as part of a residential property to be let.
The regulations apply to; sofas, beds, bed headboards, children’s furniture, garden furniture suitable for use in a dwelling, scatter cushions and pillows, loose covers for furniture, or other similar items. The regulations do not apply to curtains, carpets, bed clothes (including duvet covers and mattress covers). Any furniture manufactured after March 1990 is likely to comply, but if the appropriate labels are not clearly marked on the furniture, compliance is in doubt and checks should be made with the manufacturer.
The Gas Safety (Installation and use) Regulations 1998
These regulations came in to affect 31st October 1994, to ensure gas appliances are properly installed and maintained in a safe condition so as to avoid the risk of Carbon Monoxide poisoning. It is the responsibility of the Landlord to ensure that ALL gas appliances and gas installation pipe work owned by them are checked for safety at least once a year by British Gas or a member of the Council for Registered Gas Installers (Corgi). In addition accurate records of the safety inspections and any work carried out must be kept. The current safety certificates must always be available for any tenant prior to them taking occupation of the property.
Faulty equipment can lead to death and a conviction of unlawful killing on a Landlord. Under the regulations any appliance that does not conform will be disconnected.
The Electrical Equipment (Safety) Regulations 1994
The above regulations impose an obligation on the Landlord to ensure that all electrical appliances left as part of the let property are safe. Cabling, fuses and plugs should also be inspected and replaced where necessary to the correct rating for that particular appliance.
Other legislation covering electrical installations is currently in force and we strongly recommend that appliances are checked regularly.
The Building Regulations 1991-Smoke Alarms
The 1991 Building Regulations require that all properties built since June 1992 must be fitted with mains operated interlinked smoke detectors/alarms on each floor. Such regulations do not exist for older properties but we strongly recommend that smoke alarms are fitted in all let properties and are regularly checked to ensure that they are in full working order.
All gas and electrical appliances and installations in rented accommodations should be tested and certified safe.
In the event of an accident you must be able to prove that all appliances were safe.
Not only can you be fined for not having proved that appliances are safe, you can also be fined for causing Carbon Monoxide poisoning in an event of a defective gas appliance. Landlords cannot ignore their liability for death or personal injury resulting from negligence. Gas installations can leak deadly Carbon Monoxide (CO). Carbon Monoxide is undetectable: You can not see it, smell it or even taste it but it could injure you or even kill you if you breath it in.
Landlords must have gas installations and appliances in rented accommodation tested and certified safe each year.
LANDLORD PROTECTION PLAN
This inspection is designed to ensure you do not fall foul of the relevant legislation and comprises:
Gas Inspection
Inspection and test of the gas installation and appliances, i.e. gas boiler, cooker and gas fires. This identifies any presence of gas leaks or poisonous Carbon Monoxide.
Gas Boiler Service
Neglected gas boilers can be a principle source of leaks and CO. Regular servicing not only protects your tenants but extends life of the boiler and ensures economic running.
Electrical Inspection
A visual and functional inspection of up to six domestic appliances and an earth loop test to 50% of the sockets within the property.
